Terms of Service

SMMFOXE sells social media growth services — followers, likes, views, comments, and similar engagement metrics for third-party platforms (including but not limited to Instagram, TikTok, YouTube, Facebook, Twitter/X, Telegram, and others listed in the catalog). Orders are fulfilled through an upstream reseller provider, not delivered directly by SMMFOXE. Service availability, pricing, minimum/maximum quantities, and estimated delivery times are shown on each service listing and may change at any time as the catalog syncs from our provider.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. You are responsible for providing accurate registration information, for keeping your login credentials and API key confidential, and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access to your account.

Orders are paid from a prepaid account balance. Balance is added via the checkout flow on the Add Funds page, processed by our payment partner. Deposited balance is denominated in USD, is tied to your individual account, is non-transferable to any other account or person, and cannot be withdrawn or converted back to cash except where required by applicable law. See our Refund Policy for how balance top-ups are treated once funds are added.

When you place an order you are responsible for providing a correct, public, and accessible link or username for the content or profile the order targets. Orders submitted against a private account, a deleted post, an incorrect link, or a link you do not own or are not authorized to promote may fail, deliver incorrectly, or be non-refundable at our discretion. Once submitted to the upstream provider, an order generally cannot be edited or redirected to a different link.

Estimated delivery/completion times shown in the catalog are provider estimates, not guarantees. Delivery speed depends on factors outside our control, including third-party platform behavior, provider queue load, and the target account or content’s visibility and standing on the destination platform. Orders may show as pending, in progress, partial, completed, or canceled in your order history as they are processed; statuses are polled from the upstream provider on a recurring basis and may not reflect the provider’s state in real time.

Where a service listing indicates refill or cancellation support, you may request one from your order history, subject to the window and conditions stated on that service. Refill and cancellation eligibility and outcome are determined by the upstream provider and are not guaranteed even where a service is generally marked as eligible — for example, a refill may be denied if the underlying content or account has since been made private, deleted, or otherwise altered, and an order already in progress or completed at the provider’s end cannot be recalled. Any credit due for an accepted cancellation or refill is handled per our Refund Policy.

All refunds, credits, and chargeback handling are governed by our Refund Policy, which forms part of these Terms.

You agree not to use the Service to:

• Order services for accounts, pages, or content you do not own and are not authorized to promote;
• Target content that is illegal, infringing, hateful, harassing, sexually exploitative, or otherwise violates a destination platform’s own terms of service;
• Interfere with, reverse-engineer, or abuse the Service, its API, or rate limits;
• Resell, sublicense, or redistribute access to the Service without our prior written consent (a personal API key for your own account’s use is permitted);
• Use automated means to create multiple accounts to circumvent pricing, limits, or these Terms.

Social media platforms set and enforce their own terms of service, which may restrict or prohibit purchased engagement. You are solely responsible for understanding and complying with the terms of any platform you target with an order. SMMFOXE is not affiliated with, endorsed by, or sponsored by Instagram, TikTok, YouTube, Meta, X Corp., Telegram, or any other platform referenced in the catalog. Action taken by a platform against an account or content as a result of an order — including but not limited to removal of delivered engagement, content takedown, or account restriction — is outside our control and is not grounds for a refund.

SMMFOXE does not guarantee any specific business, marketing, algorithmic, or reach outcome from using the Service. Engagement metrics purchased through SMMFOXE are provided as-is; subsequent platform algorithm changes, content removal, or natural decline in follower/engagement counts over time are normal and not a defect in the service delivered.

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that catalog pricing, availability, or delivery estimates will be accurate at all times, since these are synced from a third-party provider outside our direct control.

To the maximum extent permitted by applicable law, SMMFOXE and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising from these Terms or the Service is limited to the amount you paid to SMMFOXE in the 60 days preceding the event giving rise to the claim.

You agree to indemnify and hold SMMFOXE harmless from any claim, demand, loss, or damage, including reasonable legal fees, made by any third party arising out of your use of the Service, your violation of these Terms, or your violation of any third-party platform’s terms of service or applicable law.

We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraud or chargeback abuse, or used the Service in a way that risks harm to SMMFOXE, our provider, or other customers. Unused account balance on a terminated account is handled at our discretion and, where termination results from a confirmed Terms violation, may be forfeited.

The SMMFOXE name, logo, and website content (excluding third-party service data synced from our provider) are the property of SMMFOXE. You may not copy, modify, or use our branding without prior written permission.

Our collection and use of your personal data is described in our Privacy Policy, which forms part of these Terms.

These Terms are governed by the laws of Europe, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service should first be raised with our support team at [email protected] so we can attempt to resolve it directly before any formal proceeding.

If any provision of these Terms is found unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

We may update these Terms from time to time to reflect changes in the Service, our provider relationships, or applicable law. Material changes will update the "Last updated" date above. Continued use of the Service after a change is posted constitutes acceptance of the revised Terms.
